The important purpose of design registration is to see that the artisan, creator, of originator of a design having an aesthetic look is not deprived of his bonafide reward by others applying the same look to their goods. Essential requirement for registering design is that the design should be new or original, not previously published or used in any country before the date of application for registration. The novelty may reside in the application of a known shape or pattern to a new subject matter.

The design should relate to features of shape, configuration, pattern or ornamentation applied or applicable to an article. Thus, designs of industrial plans, layouts and installations are not registrable under the Industrial Act 2000. The total term of a registered design is 15 years. Initially the right is granted for a period of 10 years, which can be extended, by another 5 years by making an application before the expiry of initial period.

Trademark Filing & Registration :
 
Section 18 of the Trade Marks Act 1999 says that any person, claiming to be the proprietor of a trademark used or proposed to be used by him, who is desirous of registering it shall apply in writing to the registrar in the prescribed manner for the registration of the mark. The registered proprietor of the trademark gets the exclusive right to use the trademark in relation to the goods or services in respect of which the trademark is registered. Registration of a trademark offers better legal protection for action for infringement. In case of a company about to be formed, anyone may apply in his name for subsequent assignment of the registration in the company's favour.

Trademark Renewal :

The term of a trademark registration is for a period of ten years. The renewal can be done for every 10 years and it can last indefinitely if the owner continues to use the mark. However, if a registered trademark is not renewed, trademark will be removed from the register. The trademark renewal process includes preparing a renewal instruction letter, which undergoes our quality review process. Once the quality review process is completed, the renewal instruction letter is forwarded to the Intellectual property office and the docket records are updated.
